General Terms and Conditions (GTC)

For sailing trips organised by bc2020, the contractual relationship between you as a customer (participant) and bc2020 is governed by the following General Terms and Conditions (GTC). With your registration you recognise the bc2020 GTC as legally binding.

  1. With your written registration you declare your legally binding intention to conclude a cruise contract (berth charter) with bc2020. The cruise contract becomes binding for bc2020 when bc2020 confirms the booking in writing and a deposit of 50% of the cruise price has been received from you.
  2. The remaining amount of 50% of the cruise price must be transferred no later than 12 weeks before the start of the cruise without any further request for payment. If there are less than 12 weeks between the date of the invoice and the start of the cruise, the cruise price is due in one installment.
  3. If we have not received the remaining payment by 10 weeks before the start of the trip, bc2020 may withdraw from the contract and demand the corresponding cancellation costs as a substitute.
  4. The price includes your berth and the use of the yacht including qualified skipper. The use of the yacht with skipper is exclusively for the persons making the booking. Incidental ship costs and on-board cash are incurred at cost and are paid by you as the customer on a pro rata basis. These include catering, fuel, gas, harbour and mooring fees, final cleaning, regatta and starting fees, tourist taxes, country-specific fees, canal fees, lock fees, etc. Each cruise participant is responsible for other individual costs.
  5. Participation in any sailing trip is exclusively at your own risk. A sailing trip is a sporting event that requires the health and fitness of every crew member. The type of sailing trip and the sailing trip requirements are described in detail on our website bc2020.de. No transport or package holiday contract is concluded with bc2020.
  6. In the interests of a professionally maintained yacht, defects of any kind must be reported to the skipper immediately. Should there be any complaints, these must be recorded in writing during the cruise and handed over to the skipper before departure (clearing out). Later complaints are not relevant. If claims for damages are justified, the maximum claim may not exceed the price you have paid for the cruise, unless the skipper has acted with intent or gross negligence.
  7. The yacht is fully comprehensive and liability insured.However, as a cruise participant you are liable for damage caused by you intentionally or through gross negligence; any damage bills will be settled immediately on site.
  8. If you are unable to keep to your travel plans, please inform bc2020 of your cancellation immediately.The cancellation costs per person/ship are: up to three months before the start of the cruise 50% of the cruise costs, thereafter 100% of the cruise costs.In order to protect you and bc2020 from unforeseeable travel obstacles, bc2020 recommends that you take out travel cancellation insurance.
  9. You can be represented by a substitute until the start of the trip. We may object to the change if the substitute does not fulfill the requirements for the trip. The substitute person will take your place for all rights and obligations in the contract.
  10. A participant who cancels a cruise that has already begun is not entitled to a refund of the cruise price, not even pro rata.
  11. For safety reasons, the skipper’s instructions must be followed at all times. A participant whose behaviour endangers his/her own safety or that of the crew on board may be excluded from further participation in the cruise. This also applies in the event that a participant is in breach of contract and repeatedly fails to comply with the skipper’s instructions. In this case, the participant concerned shall have no further legal claims; the contract shall be cancelled. bc2020 accepts no liability for any consequential costs incurred.
  12. In the event of exceptional circumstances, e. g. lack of operational readiness of the ship, natural disasters, sovereign order, strike, civil unrest, war or other serious events, bc2020 is entitled to withdraw from the contract. In such cases, the full price of the cruise will be refunded. Further claims are excluded.
  13. Deviations in the course of the cruise and in the equipment shall only result in a right to a corresponding reduction in the cruise costs if they were caused by gross negligence and represent a significant reduction in the cruise. Individual items of equipment may deviate from bc2020 specifications. This does not constitute a reduction in performance. If the boat cannot be made available on time for one of the reasons mentioned, the participant may cancel the contract after three days.In this case, the participant will receive a full refund of the cruise costs. The deadline is calculated from 12 noon on the first day of the cruise up to a layover period of three days. The participant may receive a pro rata refund of the cruise costs if the ship is laid up for longer than three days due to an accident, breakdown or damage to essential on-board equipment, calculated from 12 noon on the first day of the cruise.
  14. Liability for cancellation or postponement of the cruise is excluded if this is caused by force majeure, revolution, strike, political unrest or intervention by higher authorities. If the safety of the ship and participants requires a change in the scope and / or execution of the cruise, this shall not justify any claim for compensation or reduction. The decision is the sole responsibility of the ship’s command.
  15. All legal consequences and costs arising from non-compliance with passport, visa, customs, foreign exchange, drug and health regulations shall be borne exclusively by the participant responsible, as shall the resulting costs for any damage incurred. The same applies to offences against §233 StGB (human trafficking).
  16. If an individual provision of these terms and conditions is invalid, this shall not affect the validity of the remaining provisions. Verbal agreements are only valid if they are confirmed by us (bc2020) in writing.
  17. bc2020 reserves the right to amend these General Terms and Conditions at any time and without separate notification.
  18. Place of jurisdiction is Oldenburg in Oldenburg (Germany).
